Vast volumes of case law within each of these four paradigms describe four different approaches that the AIT appellate adjudicators had at their disposal. However, none of them offer a complete and undebatable answer.

The story of margarine and dairy in Canada tells tales about the country and its internal trade regime. It reveals a long-standing national propensity to protect the dairy industry, a clash in the interests of western and eastern Canadian farmers, and transformations in agricultural economics. Trade barrier controversies over protectionist dairy policies have also provided an important foundation for Canada’s internal trade case law. The building blocks for core elements of the nation’s internal trade rules, including the national treatment principle and the like-products analysis, come from dairy-filled disputes.
